Ordering extracts from the land register relating to property rights is subject to the regulations of the Grand Ducal Regulation of 10 August 2018 laying defining the conditions and procedures for consulting and issuing cadastral, topographic, cartographic and geodesic documentation managed by the administration of the land register and topography [...], which distinguishes between point geographical location (Article 8. 1°) and large geographical location (Article 8. 2°).
- For a specific geographical location, the applicant indicates the location using the address of the property, its location on a map or the plot number for a maximum of 10 adjoining plots (with a maximum of 20 neighbor plots). The point location - in the case of a vertical cadastre - is equivalent to 10 lots.
- The one-off situation is limited to one order per person per day.
- In the case of a large geographical location (more than 10 adjoining plots), the application must justify the mission of public interest or relating to the exercise of public authority to which the applicant refers.
- No information on land register entries is provided by telephone
In its judgment of 12 January 2023, the European Court of Justice held that Article 15(1)(c) of the General Data Protection Regulation ‘ must be interpreted as meaning that: the data subject's right of access to personal data concerning him or her, as provided for by that provision, implies, where those data have been or will be communicated to recipients, an obligation on the part of the controller to provide that person with the actual identity of those recipients... ’.
- The identification requirement has led the Land Registry and Topography Administration to introduce :
- strong authentication via LuxTrust of the applicant (recipient) for all online requests ;
- identification of the applicant (recipient) by means of an identity document at the counter.
- The identity of the applicant (recipient) must be disclosed to the owner at the latter's express request.
- The administration therefore suggests that professional customers use professional LuxTrust certificates for all their employees who make requests on their behalf, thereby avoiding having to disclose the personal data of requesting employees.
